By accessing or using Item Radar ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Item Radar provides a notification service that alerts users when new eBay listings matching their saved searches become available. The Service includes features for creating and managing search alerts for eBay listings, with both free and paid subscription options.

3. User Accounts

You may be required to create an account to use the Service. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription and Payment

Item Radar offers both free and paid subscription tiers with different features and capabilities. Paid subscriptions are billed according to the plan you select. You may cancel your subscription at any time. No refunds will be provided once a subscription has been purchased. Cancellation of a subscription will not result in a refund for the current billing period. We reserve the right to change subscription features and prices with reasonable notice.

5. Affiliate Commissions

The Service may contain affiliate links to eBay listings. By using the Service, you acknowledge that Item Radar may earn a commission from qualifying purchases made through these links at no additional cost to you.

6. Prohibited Uses

You agree not to use Item Radar to: (a) violate any laws or regulations; (b) infringe on intellectual property rights; (c) distribute malware or other harmful code; (d) attempt to gain unauthorized access to systems or data; (e) engage in activities that interfere with or disrupt the Service; (f) reverse engineer, decompile, or attempt to extract the source code of our website or API; (g) abuse the system by creating excessive searches, multiple accounts (which may result in immediate account suspension), or other actions that place undue burden on our infrastructure; (h) use automated methods to interact with the Service unless explicitly authorized.

7. Limitation of Liability

To the maximum extent permitted by law, Item Radar and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service. In no event shall our total liability exceed the amount you paid for the Service in the twelve months preceding the claim.

8. Disclaimer of Warranties

Item Radar is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the Service will be error-free, secure, or uninterrupted. We make no warranty regarding the accuracy, timeliness, or completeness of notifications or listings provided by the Service.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes through the Service or via email. Your continued use of Item Radar after such modifications constitutes your acceptance of the updated Terms.

10. Termination

We may terminate or suspend your access to Item Radar immediately, without prior notice, for conduct that we believe violates these Terms, including but not limited to creating multiple accounts, unauthorized access attempts, reverse engineering of our systems, or any other abuse of the Service. We may also terminate your account for any other reason at our discretion.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Saskatchewan, Canada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Saskatchewan, Canada.
